Las cortes alemanas han indicado que podrían obligar a las empresas de hospedaje de vídeo como YouTube a buscar y eliminar de forma proactiva [NT: en inglés] videos de música que infrinjan los derechos de autor, en lugar de exigir a los titulares de derechos de autor y a los organismos de derechos de cobro que presenten avisos antes de que se eliminen los vídeos.

Deutsche Gerichte haben angedeutet, dass sie in Zukunft gewerbliche Videoportale wie YouTube dazu zwingen werden, vorsorglich Musikvideos aufzuspüren und zu löschen, die gegen das Urheberrecht verstoßen, anstatt erst zu reagieren, wenn Rechteinhaber und -verwertungsgesellschaften formal Einspruch einlegen.
Dieser Richterspruch folgt auf eine Verurteilung von drei YouTube-Managern im Februar dieses Jahres in Italien. Das Urteil des italienischen Gerichts impliziert deutlich, dass jedes gehostete Video vor der Veröffentlichung überprüft werden sollte.

Duitse rechters hebben aangegeven dat ze misschien video hosting bedrijven zoals YouTube zullen dwingen om proactief op zoek te gaan naar muziekvideo's die inbreuk maken op auteursrecht en deze te verwijderen, in plaats dat houders van auteursrechten en de rechtenorganisaties eerst een verzoek moeten indienen vóórdat video's worden verwijderd.
Dit komt bovenop de veroordeling van drie YouTube executives in Italië afgelopen februari, waar de uitspraak van het Italiaanse gerecht een duidelijke implicatie inhield dat elke gehoste video vooraf gescreend zou moeten worden.

German court opinion reinforces growing gap between liability faced by US and European web hosts

German courts have indicated that they may force video hosting companies such as YouTube to proactively search out and delete music videos that infringe copyright, rather than requiring copyright holders and rights collection agencies to submit takedown notices before videos are removed.
This comes on top of the conviction last February of three YouTube executives in Italy where the ruling of the Italian court included a clear implication that every hosted video should be pre-screened.

We've been thrilled by the response, and will be busily double-checking our figures for a few days. Less than one hour left! October Drive and the OTW by the numbers!
It's been an exciting October drive, and we have less than an hour left -- we close things up (and stop marking donors as eligible to vote!) at midnight UTC tonight (What time is that where I am?)
We thought we'd give you a last minute reminder, and ask you to help make this drive our most successful to date. And while we do that, we wanted to share a few numbers!
As of right now, the OTW has 677 voting members in good standing, hailing from 32 countries across the globe. We've raised US$13,793.46 from 269 separate contributions, with an average donation amount of US$51.28. We had two donation matching grants -- one for US$2,000 and one for US$2,200. 74 of our donors during this drive opted for a premium.

October Drive - Celebrating our Vidding Roadmap!
The final project we have time to talk about during this drive is one of the newest and, we think, one of the most exciting. Our Vidding Roadmap. What's that? An economy pack of assorted awesome things -- initiatives that will serve a purpose beyond vidding, and which we believe will educate, advocate, and entertain. It includes a portal for learning about vidding, aimed at the curious, whether they are coming from inside fandom or from outside; a safe, stable place to store vids for the future; a way to share multimedia fanworks; and integration of multimedia into the Archive of Our Own.

October Drive - Celebrating Transformative Works and Cultures!
There are a lot of reasons Transformative Works and Cultures (TWC), the OTW’s international, peer-reviewed academic journal, is worth supporting. First is its role as a home for rigorous examination of transformative works. Published twice a year, TWC explores fanworks, fans, and media studies through diverse lenses and critical approaches. The journal alternates between one themed issue and one general issue each year. The editorial board is comprised of scholars who are engaged in some of the most innovative and engaging work in the field. And the work it publishes is thought-provoking and scholarly.
